Description
Where the attorney asks a question that does not relate to the redirect/recross.
Purpose/Policy/Reason
To keep the attorney from straying away from the issue brought up in the redirect/recross and wasting everyone’s time.
Examples
Could you tell me some more about the day of the incident?”
(In this case, the recross was about the day before the incident and did not cover the actual day of the incident. Therefore the question is beyond the scope and objectionable.)
Was this the knife you saw Joseph stab Julia with?”
(In this case, the recross was just about the mental state of the defendant and the question is asking about the alleged murder weapon. The question has nothing to do with the recross and is beyond the scope.)
Was it Karsyn who tried to sell the shares of the Ponzi Scheme to you?”
(In this case, since the redirect about the witness’s business knowledge, the question is beyond the scope of the redirect.)
